2. Purpose
These terms define the conditions under which the seller offers surfcasting rod spikes, accessories and related products for sale.
They apply without restriction or reservation to all sales concluded through this website.
3. Products
The products offered are described and presented as accurately as possible.
Products may be manufactured using 3D printing. As a result, slight variations in appearance, texture, colour or finish may occur between products.
Images, photographs and 3D models are provided for illustration and are not contractually binding. Colours displayed on screen may differ slightly from the actual product.
Minor design or ergonomic changes may be made to improve the product without altering its main function. Products are described and presented as accurately as possible. However, small variations in colour, texture or finish may occur, particularly in 3D-printed parts.
Photographs are not contractually binding.
4. Prices
Prices are stated in euros (€), inclusive of all taxes (VAT not applicable under Article 293B of the French General Tax Code — auto-entrepreneur scheme).
Examples:
- Rod spike assembly without aluminum spike: 39,90 €
- Rod spike assembly with 1.50 m aluminum spike: 59,90 €
The seller reserves the right to change prices at any time, but products will be charged at the price in effect when the order is placed.
5. Orders
An order is confirmed once payment is confirmed.
Placing an order constitutes full acceptance of these terms.
The seller reserves the right to refuse an order in the event of a previous dispute with the customer.
6. Payment
Payments are secure and may be made by:
- Credit or debit card
- Paypal
- Other payment methods offered on the website
Orders are processed only after payment has been received.
7. Delivery
Products are delivered to the address supplied by the customer when placing the order.
Indicative delivery time: 2 to 7 working days (excluding exceptional periods).
The seller cannot be held responsible for delays attributable to the carrier.
8. Right of withdrawal
Under Article L221-18 of the French Consumer Code, the customer has 14 days from receipt of the product to exercise their right of withdrawal.
Return shipping costs are payable by the customer.
The product must be returned complete, in its original condition, unused and properly packaged.
Under Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to personalised products or products made to the customer’s specific choices (including colour, configuration or particular options). Under Article L221-18 of the French Consumer Code, the customer has 14 days from receipt of the product to exercise their right of withdrawal.
Return shipping costs are payable by the customer.
The product must be returned in its original condition, unused.
Personalised or custom-made products are not subject to the right of withdrawal.
9. Warranties
Products are covered by the statutory guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
Any improper use (impacts, modifications, incorrect installation or excessive tightening) excludes warranty coverage.
The warranty specifically excludes:
- normal wear resulting from use,
- damage caused by sand, salt, corrosion or lack of maintenance,
- work or repairs carried out by the customer without the seller’s prior agreement.
3D-printed plastic parts may show minor variations in appearance (layer lines or colour shades) which do not constitute a lack of conformity. Products are covered by the statutory guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
Any improper use (impacts, modifications or misuse) excludes warranty coverage.
10. Liability
The products sold are intended exclusively for recreational and/or competitive fishing.
The customer is solely responsible for installing, adjusting and using the product. Before each use, they must check the condition, tightness and stability of the complete setup.
The seller cannot be held liable for damage to property, personal injury or non-material loss arising from:
- incorrect installation or adjustment,
- improper or unintended use (leaning, lifting, pulling or use for safety purposes),
- modification of the product,
- adverse environmental conditions (wind, waves or currents).
These products are not safety equipment under any circumstances. The seller cannot be held liable for damage resulting from misuse of the product.
Rod spikes are fishing equipment and are used under the user’s responsibility.
11. Intellectual property
All elements of this website (text, images, models, designs and 3D files) are the seller’s exclusive property.
Any reproduction, including partial reproduction, is prohibited without prior written permission.
12. Personal data
The personal data collected is necessary to process orders.
It is neither sold nor transferred to third parties.
Under the GDPR, customers have rights of access, rectification and erasure of their data.
13. Governing law – Disputes
These terms are governed by French law.
In the event of a dispute, an amicable solution will be sought before any legal proceedings.
Failing this, the French courts shall have exclusive jurisdiction.
14. Acceptance
The customer acknowledges having read these Terms and Conditions of Sale, together with the conditions of use, recommendations and technical limitations in the instructions supplied with the product.
These documents form an inseparable contractual whole.
